Terms and conditions of Twintour

The conditions governing activities relating to the organization and sale of trips or stays are governed by law no. 92-645 of July 13, 1992 (J.O. of 14.07.92) and its implementing decree no. 94-490 of June 15, 1994 (J.O. of 17.06.94) and apply to the proposed trip.

Registration implies acceptance of these terms and conditions.

1. Registrations

To take part in the proposed trip, the registration form must be signed and returned with a deposit of 40%; the balance must be paid 45 days before departure.

If the balance has not been paid by this date, the trip registration will be considered cancelled and the customer will be liable to pay the cancellation fees set out in paragraph 4 of these conditions.

A copy of these general terms and conditions of sale must be returned duly signed at the same time as the registration form. Once the trip has been confirmed, a signed copy of the order must be sent to us.

2.price list

Our prices include the services indicated on the order form, which vary according to the circuit or rally proposed.

3.cancellation / modification by the organizer

TWINTOUR reserves the right to cancel a trip 45 days prior to departure due to unforeseen circumstances.

If possible, a different departure date will be proposed to the participant.

If the customer cannot accept the modification, the amounts paid will be refunded in full.

The organizer reserves the right to modify the tour or departure dates if imposed by shipping companies, other service providers or other unforeseeable events.

4. Cancellation by the customer

In accordance with article L.221-28-12 of the French Consumer Code, the right of withdrawal cannot be exercised in the case of off-premises tourist packages.
In the event of cancellation, the customer must inform TWINTOUR of his decision by post. Depending on the date of cancellation, the customer will have to pay the following cancellation fees: (as per postmark).

- More than 60 days before departure............... 20% of total amount
- 59 to 40 days before departure ...............40% of total amount
- 39 to 20 days before departure ...............60% of total amount
- 19 to 10 days before departure.................80 % of total amount
- Less than 10 days before departure ...........100 % of total amount

5. Assignment of a contract

The participant may assign his or her contract before the start of the trip to a person who meets all the conditions required for the trip and who has signed these conditions.

Replacement by another participant will incur a flat-rate charge of €90. The transferor and the transferee will be jointly and severally liable for payment of the balance of the price.

6. Limits of liability

TWINTOUR is not responsible:

Maritime transport: a shipping company may have to change the date of departure, particularly in the event of a strike by company or port personnel, or for reasons of passenger safety, or for any delay due to weather conditions.

In this case, TWINTOUR cannot be held responsible and no compensation can be claimed, even in the event of a change to the program initially planned.

Defects, illegal or wrongful acts by hoteliers and other service providers, as well as their employees and agents, causing damage to participants, their belongings and personal effects.

In the event of interruption or cancellation of the trip caused by incidents of force majeure (war, revolt, disaster, epidemic, etc.) TWINTOUR will not assume the costs and disbursements caused by these incidents.

In the event of conflict or unrest in the countries visited, TWINTOUR will not be held responsible for the impossibility of providing all or part of the services.

TWINTOUR is not responsible for any loss, theft, personal injury or property damage that may occur during the trip. The participant agrees to waive any civil or criminal recourse against TWINTOUR.

TWINTOUR cannot be held responsible for traffic accidents or incidents caused by external factors (weather conditions, poor road conditions, stray animals, natural disasters).

TWINTOUR will not be held responsible for non-payment of extras by participants, for any damage or deterioration they may cause during the trip, or for any legal proceedings for which participants may be liable, all of which are the exclusive responsibility of the participant.

7. Participant's obligations

Participants are fully responsible for their own safety and that of their accompanying family and friends.

The participant must respect the rules and laws in force in the countries visited.

In the event of transgression, the rider will be held solely responsible, particularly if he or she fails to wear a helmet (for motorcyclists), or in the event of use, possession or transport of narcotics, as well as in the event of exceeding the legal blood alcohol level.

He undertakes to respect the speed limits and safety rules in force in the country.

He or she must be accustomed to driving the vehicle and be able to pilot it for an extended period.

The participant undertakes to return the vehicle to France, Twintour being released from all liability.

8. Insurance

Twintour suggests that participants take out AXA group insurance to cover the risks of trip cancellation, loss of luggage and medical repatriation. Any repatriation of the vehicle must be carried out by the participant's vehicle insurer.

The following cover is available to people who have their usual place of residence in Metropolitan France, European border countries and Switzerland, for a premium of 3.05% of the cost of the trip. A summary of cover is given below. The general provisions of the contract will be sent to you at the same time as your travel brochure.

Cancellation : reimbursement of sums due according to the terms of sale of the trip described above (excluding booking fees) when you are obliged to cancel your trip before departure, in the event of serious illness, serious accident or death of yourself, your spouse or partner or the person accompanying you, provided it appears on the same invoice (including aggravation of previous illnesses and after-effects of a previous accident) of your ascendants or descendants and/or those of your spouse or those of the person accompanying you, provided it appears on the same invoice, of your brothers, sisters, brothers-in-law, sisters-in-law, sons-in-law, daughters-in-law.

The insurer also intervenes following: complications of pregnancy before the 6th month, redundancy of you or your spouse. Destruction of more than 50% of your business and/or private premises by fire, explosion or water damage.

Excess €18 per person. All claims must be reported to Twintour within two days (by fax, e-mail or postmarked), then confirmed by registered letter with acknowledgement of receipt to Twintour within five days (2 days for luggage) and to the insurance firm DIOT MONTAGNE Immeuble Acropôle 88, av. d'Aix-les-bains 74600 SEYNOD. In all cases, the date on which the loss occurs will determine the amount of insurance compensation.

What is not covered by cancellation insurance :

Exclusions common to all risks: civil or foreign war, riots, civil commotion, voluntary participation by an insured person in riots or strikes, pandemics and viral epidemics of any kind, disintegration of the atomic nucleus or any irradiation from a radioactive energy source, alcoholism, drunkenness, use of non-medically prescribed medication, drugs or narcotics, any intentional act that may entail coverage under the contract.

Cancellation due to hospitalization at the time the trip is booked or the contract is taken out. Complications of pregnancy when the person is more than 6 months pregnant at the time of departure.

Illness requiring psychological or psychotherapeutic treatment, including nervous breakdowns, which have not required hospitalization for at least 5 days at the time of trip cancellation.

Vaccination contraindication or omission

Accidents resulting from the practice of the following sports: bobsleigh, rock-climbing, skeleton, mountaineering, competitive luge, all aerial sports, as well as those resulting from participation in or training for matches or competitions.

Non-presentation, for any reason whatsoever, of documents required for travel, such as passports, visas, tickets, vaccination booklets.

Illnesses or accidents first diagnosed, relapsed, aggravated or hospitalized between the date of purchase of your trip and the date of purchase of this policy.

Luggage: €800. Reimbursement of objects and personal effects in the event of loss by a transport company, theft or damage. Excess of €55 for damage to luggage. Sound or image reproduction equipment, jewelry and other valuables are reimbursed up to 50% of the insured amount.

Civil liability: bodily injury: €4,573,470 per claim, property damage: €75,000 per claim - legal defense: €1,520 per dispute - advance on penal bond: €7,623 per accident.

Repatriation assistance: transport, medical repatriation: transport costs - additional reimbursement of medical costs abroad: €7623, dental costs: €76 - excess per event: €35 - advance on hospitalization costs abroad: €7623 return of family members: transport costs - presence in hospital: transport costs - hotel costs: (max. 10 days) max. €60 per day - transport of body in the event of death: transport costs - coffin costs: max. €762 - early return: transport costs - search, rescue and salvage costs at sea or in the mountains: 1.525 - shipment of medication: shipment costs - accompaniment of children under 15: transportation costs.

9.complaints

All claims must be made by registered mail no later than 15 days after return from the trip, and must be accompanied by the incident report issued by the local service provider. Please note that any complaint made by fax, telephone, ordinary mail, e-mail or any other means, or made after the deadline, or not made to the service provider(s) concerned, will not be taken into account.
In the event of a dispute, the claimant may bring the matter either before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or before the court for the place where the claimant resided at the time the contract was concluded.
After this period, no claim will be taken into consideration. We will do our utmost to settle any disputes amicably. TWINTOUR has taken out a professional liability insurance policy with GENERALI France in Paris.

TWINTOUR is financially guaranteed by APST.

10.administrative formalities

The participant must provide the following documents:A valid driver's license.

Valid identity card for European countries and valid passport for non-European countries.

Vehicle registration document, and if you don't own the vehicle, a signed authorization from the owner.

Insurance certificate (green card) showing that the country you are visiting is covered by your insurance company (particularly for Morocco).

If the participant does not take out the insurance proposed in paragraph 8, and does not pay for the entire trip with a "top-of-the-range" bank card that covers medical repatriation, he/she must ensure that his/her insurance covers medical repatriation.

11.Miscellaneous

In the event of mechanical breakdown or accident, the participant will have to deal with the problem through his or her own car insurance. Twintour does not offer mechanical assistance.
Stages may be modified for imperative reasons.
